These Terms and Conditions (“Terms”) govern your use of the Wakefuli mobile application and related services (“Wakefuli”, “App”, “Services”), operated by Wakefuli LTD (“we”, “us”, “our”).

By creating an account, accessing, or using Wakefuli, you agree to be bound by these Terms. If you do not agree, you must not use the App.

2. DEFINITIONS

User – Any individual who accesses or uses Wakefuli.
Student Profile – A user profile that may create and practice personal events for private use only.
Coach Profile – An optional profile that may create events and content accessible to other users in the Wakefuli community, subject to verification.
Event – A structured practice session created within Wakefuli.
Techniques – Practices, exercises, or informational content provided by Wakefuli or Coaches.
Basic Journey Membership – Free membership with limited access.
Complete Journey Membership – Paid membership granting full access to all features.

3. ELIGIBILITY

Wakefuli is intended for users aged 13 years or older.
By using the App, you confirm that you meet this requirement.
If you are under the age of 18, you confirm that you have permission from a parent or legal guardian.

4. USER ACCOUNTS

Users must create an account using an email address and a password.
You agree to provide accurate, complete, and up-to-date information.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity conducted under your account.

5. STUDENT & COACH PROFILES

5.1 Student Profiles

Student Profiles may:

Create Basic Timer Events
Create Self-Practice Events
Access Wakefuli’s technique library
Log private journals and self-inquiries (visible only to the user)

5.2 Coach Profiles

Coach Profiles may:

Create Pre-Recorded Events
Create Live-Stream Events
Share practices with the Wakefuli community
Earn revenue based on user engagement (subject to platform rules)

Coach Profiles require submission of documentation verifying relevant qualifications or training. Wakefuli reserves the right to approve, reject, suspend, or revoke Coach status at its discretion.

Important: Verification does not constitute endorsement or guarantee of competence.

6. EVENTS & TECHNIQUES

Events may include Techniques selected from Wakefuli’s library or created by verified Coaches. Techniques may include introductions, instructions, benefits, physiological explanations, and other educational information.

Wakefuli does not guarantee outcomes, results, or suitability for any individual user.

7. INTELLECTUAL PROPERTY

7.1 Wakefuli Content

All Wakefuli-created content, including but not limited to:

Text
Graphics
Logos
Icons
App design
Technique descriptions
Audio and visual materials

is the intellectual property of Wakefuli LTD and is protected by copyright and trademark laws in the UK and EU.

The name “Wakefuli” is a registered trademark in the UK and EU.

7.2 Coach-Created Content

Coaches retain ownership of their original content.
By uploading content, Coaches grant Wakefuli a non-exclusive, worldwide, royalty-free licence to host, display, distribute, stream, promote, and monetise such content within the Wakefuli platform.
This licence continues for as long as the content is available within Wakefuli.

8. USER-SUBMITTED CONTENT

8.1 Private Content

Private content such as:

Journals
Self-inquiry logs
Personal reflections

remains private and is not shared with other users.

8.2 Public or Community Content

Coach-created events and content visible to other users are subject to the licence described above.

9. PROHIBITED USE

You agree not to:

Reverse-engineer, copy, scrape, or hack the App
Upload unlawful, harmful, or misleading content
Impersonate others
Circumvent payment systems
Use the App for unauthorised commercial purposes
Interfere with the operation or security of Wakefuli

10. HEALTH, WELLNESS & PRACTICE DISCLAIMERS

Wakefuli provides educational and wellness-focused content only.

10.1 No Medical or Psychological Advice

Wakefuli:

Does not provide medical, psychological, psychiatric, or therapeutic advice
Is not a diagnostic tool
Does not replace licensed professionals

Always consult a qualified healthcare or mental-health professional before starting any new wellness practice.

10.2 Physical & Energetic Practices

Wakefuli includes a wide range of practices such as breathwork, movement, meditation, martial arts, energy work, chanting, and physical conditioning.

By using these practices, you acknowledge that:

You participate at your own risk
You are responsible for assessing suitability for your health and condition
You will stop immediately if you experience discomfort, dizziness, distress, or pain

11. MEMBERSHIPS & SUBSCRIPTIONS

Wakefuli offers a free Basic Journey Membership
· The Complete Journey Membership is billed monthly
· A 30-day free trial is offered for Complete Journey Membership
· If not upgraded, access reverts to Basic Membership after the trial

Refunds are governed by Apple App Store and Google Play Store policies.

12. ACCOUNT TERMINATION

12.1 By User

You may request account deletion at any time.

12.2 By Wakefuli

We may suspend or terminate accounts for:

Breach of these Terms
Misuse of the platform
Fraud or abuse
Legal or security reasons

12.3 Data After Deletion

Access is terminated immediately
Certain data may be retained where legally required (e.g., financial records)
Private journals and self-inquiry data may be retained temporarily for recovery purposes, then deleted or anonymised

13. LIMITATION OF LIABILITY

Wakefuli is provided “as is” and “as available.”

To the fullest extent permitted by law:

Wakefuli LTD shall not be liable for indirect, incidental, or consequential damages
We do not guarantee uninterrupted or error-free operation
Use of the App is at your own risk

14. GOVERNING LAW

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in these Terms limits mandatory consumer protections under local laws.

15. CHANGES TO THESE TERMS

We may update these Terms at any time. Users will be notified via email. Continued use of Wakefuli constitutes acceptance of updated Terms.

16. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
